Terms and Conditions

Welcome to TENUM®, a platform provided by Plentitude AI GmbH (“ we,” “ us,” or “ TENUM®”). These Terms and Conditions (“ Terms”) govern your access to and use of our TENUM® services (collectively, the “ Services”), including all software, documentation, and user interfaces.

By creating an account, accessing, or using any part of the Services, you agree to be bound by these Terms. If you do not accept all the Terms, you may not use the Services.

1. Definitions

1.1 Plentitude AI GmbH: The owner and operator of TENUM®, with its principal offices located at Candidplatz 11, 81543 München, Germany.

1.2 TENUM®: A fully hosted environment and ecosystem for developing, deploying, hosting, and maintaining software applications and projects.

1.3 User, You: Any individual or entity that creates an account on TENUM® or uses the Services.

1.4 Projects and Apps: Any software code, artifacts, or content that the User develops, deploys, or hosts using TENUM®.

2. Scope of Services

2.1 Hosted Environment
TENUM® provides a platform where Users can develop, run, and maintain applications (“Projects and Apps”) without needing their own server infrastructure. TENUM® may also provide additional tools such as testing services, AI-driven features, deployment pipelines, and dependency management.

2.2 Usage Requirements

  • You must have an active account to deploy, host, or access Projects and Apps.

  • You agree to provide accurate information when registering and to keep this information up to date.

3. User Responsibilities

3.1 Compliance
You are responsible for ensuring that your use of TENUM® (including any Projects and Apps you deploy or maintain) complies with all applicable laws, regulations, and these Terms.

3.2 Security
You are responsible for maintaining the confidentiality of any login credentials and for all actions taken under your account. You must promptly notify TENUM® of any unauthorized use or security breach.

3.3 Content Ownership and Rights

  • You retain all intellectual property rights to your Projects and Apps, except for any TENUM®-provided materials or third-party content, which remain the property of TENUM® or such third parties.

  • By uploading or deploying Projects and Apps, you grant TENUM® a worldwide, non-exclusive, royalty-free license to host, run, and display your Projects and Apps for the purpose of providing the Services.

4. Limitations and Prohibited Uses

4.1 Prohibited Content
You agree not to use TENUM® for any unlawful purposes, including but not limited to hosting malicious code, engaging in fraudulent activities, or violating intellectual property rights.

4.2 Resource Abuse
You must not use the Services in a manner that excessively or disproportionately uses TENUM® ’s system resources, unless permitted by your plan or by TENUM® in writing.

5. Fees and Billing

5.1 Subscription Plans
TENUM® may offer various subscription tiers or pay-as-you-go models. Your use of the Services is subject to the terms of the plan you select and to any additional fees for resource usage.

5.2 Payments
Payment terms (e.g., billing cycles, late fees) are described on our Pricing page or during sign-up. By selecting a paid plan, you agree to the posted rates and conditions.

6. Termination

6.1 Termination by User
You may stop using the Services at any time. If you wish to close your account, you must follow the instructions provided in your account settings.

6.2 **Termination by TENUM®
TENUM® may suspend or terminate your access if you violate these Terms, fail to make required payments, or if providing the Services to you is no longer commercially feasible in TENUM® ’s judgment.

6.3 Effects of Termination
Upon termination, you lose access to the Services, including any Projects and Apps hosted on TENUM®. TENUM® may delete your Projects and Apps from our servers unless otherwise agreed.

7. Disclaimer of Warranties

7.1 “As Is”
TENUM® is provided “as is” and “as available” without warranties of any kind, either express or implied. TENUM® does not warrant that the Services will be uninterrupted, error-free, or free of harmful components.

7.2 No Guarantee
We do not guarantee that TENUM® will meet your requirements or be suitable for your intended use.

8. Limitation of Liability

8.1 No Liability for Damages
To the maximum extent permitted by law, Plentitude AI GmbH and its affiliates, employees, agents, and licensors shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly.

8.2 Liability Cap
In no event shall our total liability to you for all claims arising out of or related to these Terms exceed the amount you have paid TENUM® in the 12 months preceding the claim.

9. Indemnification

You agree to indemnify and hold harmless Plentitude AI GmbH, its affiliates, and its employees from any claims, liabilities, damages, losses, or expenses (including reasonable attorney fees) arising out of or in any way connected with your use of TENUM®, your Projects and Apps, or your violation of these Terms.

10. International Use

TENUM® is operated from Germany and is intended for users worldwide. We make no representation that TENUM® is appropriate or available for use in locations outside of Germany. If you access TENUM® from outside Germany, you do so at your own risk and are responsible for compliance with local laws.

11. Governing Law and Dispute Resolution

These Terms are governed by the laws of the Federal Republic of Germany, without regard to its conflict of laws principles. Any dispute arising from these Terms shall be resolved in the competent courts of Munich, Germany.

12. Changes to Terms

TENUM® may revise these Terms from time to time by posting an updated version on our website. Continued use of the Services after any changes to the Terms means you consent to the new Terms.

13. Miscellaneous

13.1 Entire Agreement
These Terms (and any documents referred to herein) constitute the entire agreement between you and TENUM® regarding your use of the Services.

13.2 Severability
If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.

13.3 Waiver
No waiver of any provision of these Terms shall be deemed a further or continuing waiver of that provision or any other provision.
